____ Buyer acknowledges and agrees that deposit is nonrefundable under any circumstances except as outlined in the “Cancellation” section of this contract.

General Health Warranty: The health of the above bird(s) is excellent to the best of the Seller’s knowledge at the time of sale, and the animal is not suffering from any known disease or defect which would prevent it from living a healthy or normal life unless otherwise noted below. Any excepted medical conditions, physical defects, injuries, or illness are noted below and have been fully disclosed to the buyer. The seller encourages the Buyer to have a veterinarian examination of the bird(s) within one week of receipt of the bird(s). If veterinary exam within one week of acquisition of the bird(s) finds the bird(s) to have a pre-existing malady or to be in poor health, upon furnishing veterinary documentation the bird(s) may be returned to the seller, at the expense of the Buyer, for a full refund of the purchase price. This warranty does not cover illness caused by improper care or environment, nor any injury sustained after the bird(s) is in the custody of the buyer. Every precaution will be taken to ensure the bird(s) was/were in excellent health at the time of sale, but Rain Blossom Exotics will not be held responsible for illness or injury contracted after leaving their possession. Buyer acknowledges and accepts the conditions noted below, understands that they are not covered by this health warranty, and agrees to provide any appropriate additional care because of said conditions.

One Month Health Guarantee: Rain Blossom Exotics guarantees the bird(s) to be free from any life threatening hereditary or congenital defects or conditions for one month after sale. Should the bird(s) be found to have any such condition, the bird(s) may be returned to the seller for a refund or for a replacement bird(s) of comparable value within one month of the date of pickup. The option to provide a refund or replacement animal is at the discretion of the seller/breeder. This guarantee does not cover any conditions that may arise out of environment or due to improper care of the bird(s).
Buyer is responsible for all veterinary costs, exams, tests, medical treatments, medications, supplements, or necropsy. In addition, the buyer will be responsible for any transportation charges of the bird(s). Buyer agrees to provide proper food (including pelleted diet by Psittacus, Roudybush, Harrisson’s, HARI/Hagen, Zupreem, or Mazuri; fresh fruits and vegetables appropriate for parrots; and limited fats such as seeds and nuts), care, enrichment, medical care as needed, shelter in their home, and attention for the bird(s).

____ Wing Clipping Clause: Buyer agrees to refrain from clipping birds’ wings for at least one year (365 days) from the date of receipt of the bird(s). This is included in the definition of “proper care” for the purpose of this contract. Failure to adhere to this will nullify any health guarantees or assurance and may lead to behavioral or health problems in the bird(s).

First Right of Refusal & Return Home Policy: Should buyer be unable to keep the bird(s) for any reason, Rain Blossom Exotics shall be contacted first and given the opportunity to purchase the bird(s) back for appropriate market price. Rain Blossom Exotics also provides a “Return Home” clause on any bird(s) sold. Should the buyer be unable to keep the bird(s) and cannot find a suitable home, the bird(s) shall be returned to Rain Blossom Exotics. Buyer agrees that Rain Blossom Exotics SHALL be contacted in the event the only option for re-homing the bird(s) is taking it to a shelter or rescue facility to give the seller the opportunity to make arrangements to bring the bird(s) back or find suitable home(s).

Breach of Contract: Any breach of the above contract may result in legal action. In the event of breach of this contract, Rain Blossom Exotics may take legal action including repossession of the bird(s), recovery of punitive damages and recovery of all expenses associated in remedying the breach of contract including but not limited to: Attorney's fees, transportation, unpaid wages, shipping, and vet expenses. No refunds shall be issued if any breach of contract results in the repossession of the bird(s). Should buyer not allow Rain Blossom Exotics to take peaceful possession of the bird(s), buyer agrees to pay Rain Blossom Exotics any court costs, attorney’s fees, and any other expenses borne by Rain Blossom Exotics in the effort to secure possession of the bird(s).

Cancellation: Seller reserves the right to cancel this contract and refund any deposits or payments made towards the price of the bird at any time, and under any circumstances, especially if:

a)            Seller determines, based on buyer’s words or actions, that buyer will not provide adequate quality of care for bird(s) in question or that the bird(s) in question will not be an appropriate fit for the buyer’s home;

b)            Buyer becomes hostile, threatening, excessively demanding OR engages in any form of public or private slander against the seller; AND/OR

c)            Seller is unable, in Seller’s best judgment, to complete the transfer of the bird(s) in a reasonable amount of time after weaning due to unforeseen circumstances.

Buyer may choose to cancel at any time for any reason. However, non-refundable deposit shall be deemed forfeit in consideration of lost potential clients, as well as time and effort on Seller’s part to provide updates and education for Buyer.

Deposit and Refund: The nonrefundable deposit outlined at the beginning of this contract shall not be refunded in the case of the buyer choosing to cancel, regardless of buyer circumstances. Payments additional to the deposit may be refunded, less boarding fees of $10/day.

If any part of this contract requires legal action in order to compel compliance, resolve a dispute or secure a judgment, buyer agrees that venue shall lie in Clallam County, Washington state.
